ARYA offers a mobile messaging program (the “Program”) subject to these Terms and our Privacy Policy. By opting into or participating in the Program, you agree to these terms and conditions, including resolving disputes via binding, individual arbitration as detailed below.

By subscribing, you agree to receive recurring automated marketing and promotional text messages (e.g., SMS and MMS) from ARYA to the mobile number you provided. These may include cart reminders, promotions, order updates, and other communications.

  • Consent to receive messages is not required as a condition of purchase.

  • Message and data rates may apply.

  • Message frequency varies.

2. User Opt-Out

To stop receiving messages, reply with one of the following keywords: STOP, END, CANCEL, UNSUBSCRIBE, or QUIT. You may receive a final message confirming your opt-out. Other keywords or methods will not be recognized as valid requests to unsubscribe.

3. Duty to Notify and Indemnify

If you change or deactivate your mobile number, you agree to opt out before doing so. Failure to notify us may result in liability for message delivery to the new number holder. You agree to indemnify ARYA for any such claims.

4. Program Description

Users who opt in may receive messages regarding the marketing and sale of ARYA’s products, services, and events. This includes promotions, order updates, restocks, or news.

7. MMS Disclosure

9. Participant Requirements

You must:

  • Own the mobile number provided;

  • Use a supported wireless carrier;

  • Have a device capable of two-way messaging.

Age Restrictions

You must be at least 13 years of age to use this site or participate in the Program. If under 18, you must have permission from a parent or legal guardian. By using the site, you confirm you meet these requirements.

Prohibited Conduct

You agree not to transmit content through our services that is:

  • Fraudulent, libelous, defamatory, harassing, or threatening;

  • Containing viruses, malware, or harmful code;

Binding Individual Arbitration

By using the Site or participating in the Program, you agree to resolve any disputes with ARYA through binding individual arbitration governed by the Federal Arbitration Act.

  • Arbitration will occur in Los Angeles, California.

  • Each party will bear its own legal costs unless otherwise awarded.

Mandatory Informal Process

Before initiating arbitration, you must contact us at support@aryagolf.com with a written notice describing the dispute and giving us 60 days to try to resolve it informally.

Disclaimer of Warranties & Limitation of Liability

ARYA provides the website and services “as is” without warranties of any kind. We do not guarantee that the site or any content will be error-free, uninterrupted, or secure. To the fullest extent permitted by law, we disclaim all liability for any damages, including direct or indirect loss.
